Terms of Service

1. About Mimiqo

Mimiqo is an AI-assisted SaaS platform that helps businesses create Instagram post drafts aligned with their existing brand voice.

Depending on the enabled features and granted permissions, Mimiqo may analyze existing brand content, build an internal brand voice profile, generate new content drafts, and support review and approval workflows.

2. Accounts and Authorization

You must be at least 18 years old to use Mimiqo.

You may only use Mimiqo if you have the authority to act on behalf of the business, brand, or account you connect to the service.

You are responsible for maintaining the security of your login credentials and for all activity conducted under your account.

3. Subscription and Payments

Mimiqo is offered on a subscription basis, unless otherwise agreed in writing.

Subscriptions renew automatically until cancelled.

You may cancel at any time. Cancellation takes effect at the end of the current billing period, unless otherwise indicated.

We may change prices in the future. If a price change is material, we will provide advance notice before the change takes effect.

Unless required by applicable law, fees already paid are non-refundable.

4. Customer Content and Ownership

You retain full ownership of your original content, brand assets, and materials uploaded or connected to Mimiqo.

Mimiqo does not claim ownership of your posts, media, descriptions, or brand identity.

To provide the service, you grant Mimiqo a limited, non-exclusive, revocable license to access, host, analyze, process, transform, and internally display that content to the extent necessary to operate the platform.

Generated drafts and suggestions are made available to you for use in accordance with applicable law and these Terms. You are responsible for reviewing them before publication or external use.

5. Brand Voice Profile

Mimiqo may create an internal brand language or communication style profile based on your content.

This profile is used to generate subsequent content drafts more consistently with the brand's existing communication.

This profile is part of the service and is not shared with other customers.

6. Optional Showcase Use

By default, Mimiqo does not use customer-generated content for public marketing or portfolio purposes.

If Mimiqo offers an optional marketing consent to showcase generated materials, that consent will be explicit, voluntary, revocable, and off by default.

Without your express consent, Mimiqo does not use original customer content in a public portfolio.

7. Third-Party Platform Integrations

Mimiqo may integrate with third-party platforms, including Meta / Instagram, using authorized APIs and official permission flows.

Use of those platforms remains subject to their own terms and policies.

You may disconnect a connected account in accordance with the technical capabilities of the relevant integration.

8. AI and Service Limitations

Mimiqo uses AI to analyze content and generate post drafts.

AI-generated outputs may be inaccurate, incomplete, inappropriate, or not aligned with the requirements of your industry, market, or regulations.

You are responsible for reviewing, approving, and, if applicable, publishing generated content.

Any quality scores, warnings, or consistency indicators are advisory only and do not constitute guarantees of accuracy, safety, or legal compliance.

9. Acceptable Use

You must not use Mimiqo in a way that violates the law, third-party platform rules, or the rights of other people.

You must not use Mimiqo to impersonate other brands or individuals without authorization, generate fraudulent, hateful, violent, or illegal content, or circumvent limits, controls, or service restrictions.

10. Suspension and Termination

You may stop using Mimiqo at any time.

Mimiqo may suspend or terminate access to the service if you breach these Terms, fail to pay applicable fees, create a material security risk, or use the service in a prohibited manner.

How data is stored and deleted after termination is described in the Privacy Policy and, where applicable, the Data Processing Agreement.

11. Disclaimer of Warranties

Mimiqo is provided "as is" and "as available," unless applicable law requires otherwise.

We do not guarantee uninterrupted availability, error-free operation, availability of third-party services, or specific business or marketing outcomes.

12. Limitation of Liability

To the maximum extent permitted by law, Mimiqo shall not be liable for indirect, incidental, special, consequential damages, loss of profits, revenue, data, reputation, or business opportunities.

To the extent permitted by law, Mimiqo's aggregate liability is limited to the amount paid by you for the service during the applicable reference period, if any.

13. Changes to These Terms

We may update these Terms from time to time.

If a change is material, we will notify you before it takes effect.

Continued use of the service after the effective date of the changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of Poland, unless mandatory local law requires otherwise.

For business customers, disputes shall be resolved by the court competent for Mimiqo's registered seat, unless otherwise agreed in writing.
